Bankruptcy and the Constitution
The U.S. Constitution gives  Congress the Power to "establish . . . uniform Laws on the subject of Bankruptcies throughout the United States" U.S. Constitution, Art. 1, Sec. 8.


U.S. Bankruptcy laws derive from English laws, which in turn trace their origin to laws "introduced by the Christian emperors of Rome, whereby, if a debtor ceded, or yielded up all his property to his creditors, he was secured from being dragged to gaol."
